Welcome to DivyanshiCAB. Thank you for using our services. When you use our services, you accept our terms & conditions. Please read them carefully before using our website or services. By using Divyanshi Cab's services, you agree to all the terms and conditions stated below. These terms apply to all passengers, users, drivers and car owner partners.

1. Definitions

  • 'Vehicle' — any cab/taxi provided to the customer for the performance of the services.
  • 'Company' / 'We' / 'DivyanshiCAB' — Divyanshi Transport Business Private Limited, including authorized representatives, employees and agents.
  • 'Customer' / 'You' — any person availing services provided by the Company.
  • 'Service Provider' — any person or entity possessing the vehicle and providing transport services to the customer.
  • 'Services' — ride-hailing, pickup & drop and transportation services provided by the Service Provider.
  • 'Force Majeure' — strikes, riots, war, terrorism, traffic disruption, government action, fuel shortages, abnormal weather or any cause beyond the reasonable control of the affected party.

2. General Information

  • The Company provides technology-based services for booking cabs in certain cities of Bihar. You agree to avail of services offered by third-party Service Providers.
  • The Company takes your booking request and forwards it to the Service Provider. The Service Provider has discretion over whether to accept the booking request.
  • For the avoidance of doubt, the Company itself does not provide the Services. The Service Provider renders the Service to you. The Company shall not be held liable if the Service Provider fails to arrive or render services after accepting a booking.
  • You warrant that the information you provide to the Company is accurate and complete.
  • You will refrain from doing anything which we reasonably believe to be disreputable or capable of damaging our reputation.
  • You will treat the Service Provider with respect and not cause damage to their vehicle or engage in any unlawful, threatening, harassing or abusive behaviour.
  • You will compensate and defend us fully against any claims or legal proceedings brought against us as a result of your breach of these terms.

3. Charges and Payment

  • You will make payment in full for the Services provided to you. Trip charges and rates are available on the website and app.
  • Trip charges include trip fare and additional charges including waiting charges, parking charges, night surcharge (where applicable) and any fee or levy required by law.
  • For Outstation Round Trips, charges are applicable for each calendar day. If travel extends past midnight, next calendar day round-trip charges will apply.
  • Payment may be made by cash, credit/debit card, wallet, UPI or any new payment methods the Company introduces.
  • Any payment made is non-refundable. At the end of the trip, you will receive an invoice copy to your registered email.
  • Fare estimates shown are indicative. The actual fare displayed on the billing device or communicated via email/SMS is the final fare. The Company takes no responsibility for the accuracy of estimates.
  • All fare estimates are exclusive of toll charges, parking charges and discounts. These are payable separately at actual.

4. Cancellation Policy

  • If a customer cancels the ride after 10 minutes of booking, the booking amount will be forfeited.
  • If the driver cancels the ride, the booking amount will be returned to the respective bank account within one week.

5. Indemnification

  • By accepting these Terms and using the application, you agree to defend, indemnify and hold the Company, its officers, directors, employees and agents harmless from and against any and all claims, damages, losses, liabilities and expenses arising out of: (a) your violation or breach of any term of these Terms; (b) your violation of any rights of any third party; or (c) your use or misuse of the application or website.

6. Limitation of Liability

  • The information provided on the website and application is for general information purposes only and does not constitute advice.
  • The Company shall not be liable for any damages resulting from the use of or inability to use the website or application, unless such damage is the result of wilful misconduct or gross negligence on the part of the Company.
  • The quality of Services is entirely the responsibility of the Service Provider. The Company accepts no liability in connection with any acts, conduct or negligence on the part of the Service Provider.
  • Insofar as allowed under applicable law, the Company's aggregate liability shall not exceed INR 1,000.

7. Intellectual Property Rights

  • The Company is the sole owner and lawful licensee of all rights to the website, mobile application and all digital media. All content — design, layout, text, images, graphics, sounds and video — is protected by copyright and other applicable laws.
  • All related icons, logos and trademarks are registered service marks of the Company. Unauthorized copying, modification, use or publication of these marks is strictly prohibited.
  • Subject to compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable licence to use the application on a single mobile device for your own personal use only.

8. Links to Third-Party Websites

  • Links to third-party websites on our platform are provided as a convenience only. These websites are beyond the Company's control.
  • By using our services, you agree to be bound by the Google Maps/Google Earth Additional Terms of Service, including the Google Privacy Policy.

9. Term and Termination

  • You are entitled to terminate this agreement at any time by permanently deleting the application.
  • The Company is entitled to terminate the agreement with immediate effect if you violate any of these Terms, or if the Company believes you are misusing the application or services.

10. Force Majeure / Excusable Delays

  • Neither party shall be responsible for delays or failures resulting from acts beyond its reasonable control — including strikes, riots, floods, storms, acts of God or similar occurrences.

11. Miscellaneous

  • The Courts of Darbhanga, Bihar, India shall have sole and exclusive jurisdiction over any matters arising from the use of the Company's services.
  • All claims and disputes must be notified to the Company within 30 days from the event date, after which you shall have no right to raise any claim.
  • The Company reserves the right to add, vary or amend any or all these terms and conditions at any time. Updated terms are effective upon publication at www.divyanshicab.com.
  • You authorise the Company to send service messages, offers, promotions and communications through calls, messages, emails, social media and app notifications.
